DMC WANTS 2 KNOW PLAYLIST CONTEST OFFICIAL RULES
NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN THIS CONTEST. Void where prohibited by law. Subject to all federal, state and local laws, regulations, and ordinances.
HOW TO ENTER: The purpose of this contest is to encourage participants to create their own iMixes, and to share and comment on them on this site. For tips on how to create your own iMix, please see: How to create an iMix.
A. SPONSOR: Tekserve, Inc, 119 W 23rd St, New York, NY 10011 (“Sponsor”). This promotion is in no way sponsored, endorsed or administered by, or associated with, Apple, iTunes, or Facebook. Entrant understands that entrant is providing personal information to Tekserve and not to Apple, iTunes or Facebook. The information provided will only be used for this contest. Entrant name and contact information is private and will only be used for internal company promotions and to send newsletters, updates and announcements.
B. ELIGIBILITY: Contest is open only to legal residents of the 50 United States (including the District of Columbia and outlying territories) who are 13 years of age or older at time of entry and have a valid, working email address. Employees, officers, and directors of Tekserve, Inc. and any of its affiliates, representatives, consultants, contractors, legal counsel, advertising, public relations, promotional, fulfillment, and marketing agencies, website providers, web masters, and members of their immediate families (spouses, parents, children, siblings and their spouses, regardless of where they live) are not eligible to win. Participation constitutes entrant’s full and unconditional agreement to these Official Rules and to Sponsor’s decisions, which are final and binding in all matters related to the Contest. Winning a prize is contingent on fulfilling all requirements set forth herein. Sponsor reserves the right to verify the eligibility of winner. . Sponsor reserves the right at its sole discretion to disqualify any individual it finds to be attempting to tamper with or undermine the entry process, and/or the legitimate operation of the Contest; to violate the Official Rules; or to act in an unsportsmanlike or disruptive manner or with the intent to annoy, abuse, threaten, or harass any other person. An entrant is only eligible to win one prize during the Contest Period.
C. ENTRY PERIOD: Contest begins at 2:00 p.m. ET on June 28, 2010 and ends at 11:59 a.m. ET on August 23, 2010. There will be one prize awarded during each two-week period of the Entry Period: June 28, 2010, 12:00pm – July 12, 2010, 12:00pm ET, July 12, 2010, 12:01pm – July 26, 2010, 12:00pm ET , July 26, 2010, 12:01pm ET – August 8, 2010, 12:00pm ET, August 8, 2010, 12:01pm ET – August 23, 2010, 11:59pm ET.
D. USAGE OF CONTEST ENTRIES: By submitting an entry, entrant agree that to grant the Sponsor a non-exclusive, irrevocable, royalty-free, worldwide and transferable right and license to: (1) use, review, assess, test and analyze the entry and all its content in connection with the contest, and (2) feature the entry in selected media for promotional purposes. By submitting an entry entrant understands that entrant will not receive any compensation or credit for use of the entry, other than what is described in these contest rules.
E. METHOD OF ENTRY: To enter, entrant must visit www.tekserve.com/audiovideo and submit their name, a valid email address, and the URL of a contestant-created iMix from the iTunes store. The sponsor reserves the right to verify creator of a submitted iMix. The use of Facebook Connect is not required for entry and the entrant agrees not to hold the Sponsor responsible for their private information.
F. CONTEST JUDGEMENT: Winners for each entry period will be selected by the choice of the expert judge, Daryl McDaniels (“DMC”). DMC has the additional right to empower the representatives of the Sponsor to judge the contest on his behalf. After the end of each submission period, DMC and persons appointed by DMC will judge eligible submissions based on their inventiveness, creativity, adherence to the theme and additional appropriate criteria.
G. PRIZE: Four (4) Winners will receive one (1) Apple iPod Classic 160GB music player, custom engraved and autographed by DMC. Limit one prize per person.
H. PRIZE CONDITIONS AND RESTRICTIONS: Prize is not transferable and no substitution is allowed except at Sponsor’s sole discretion. Prize may not be redeemed for cash. Winner is responsible for any loss of prize or portion of prize after it has been delivered. Sponsor will not replace any lost or stolen prizes. Any and all fees, costs, and expenses related to acceptance and use of the prize not specifically stated herein are the sole responsibility of winner. Sponsor is not responsible for any typographical or other error in the printing of the offer, administration of the Contest or in the announcement of the prize.
I. WINNER NOTIFICATION AND VERIFICATION: Each winner will be notified by email two weeks following the close of the corresponding contest entry period. Winner does not need to be online at the time of the notification. Upon verification of winner’s eligibility by Sponsor, Prize will be sent to winner’s home address. Noncompliance with the foregoing, failure to abide by these Official Rules, failure to respond within ten (10) business days after the first attempt to contact the winner, or return of the prize notification or prize as undeliverable may result in disqualification and the naming of an alternate potential winner. Alternate judgments will be held until an eligible winner can be identified. No compensation will be given upon prize forfeiture for any reason. Sponsor is not responsible for any change of mailing address, email address, and/or telephone number of entrants.
J. WINNERS LIST: All winner list requests will only be accepted after August 31, 2010 and no later than December 31, 2010. For the Winner List, send an email to gregw@tekserve.com.
K. GENERAL CONDITIONS: In the event of a dispute as to who submitted an e-mail entry, the entry will be deemed submitted by the holder of the e-mail account.. The Sponsor and its agencies, officers, directors, agents, and employees are not responsible for and shall not be liable for: (1) garbled, illegible, incomplete, damaged, misdirected, stolen, late, lost or failed electronic entries; (2) telephone, electronic, hardware or software program, network, internet or computer malfunctions, failures or difficulties of any kind including any injury or damage to entrant’s or any other person’s computer related to or resulting from participating in or downloading any materials in the Contest; (3) errors or delays in transmission; (4) any condition caused by events beyond the control of the Sponsor which may cause the Contest to be disrupted or corrupted; (5) any losses or damages of any kind caused by the prize or resulting from acceptance or use of the prize, or from participation in the Contest. The Sponsor may prohibit entrant from participating in the Contest if, at its sole discretion, entrant repeatedly shows a disregard for the Contest Official Rules, or acts: (a) in a manner the Sponsor determines to be unfair, including the use of automated processes or devices not valid for entry; (b) with an intent to annoy, threaten or harass any other entrant or the Sponsor; or (c) in any other disruptive manner. Sponsor reserves the right in its sole discretion to cancel, terminate or suspend this Contest should virus, bugs, unauthorized human intervention, systems malfunctions, failures or difficulties, or other causes beyond the control of the Sponsor and its agencies corrupt or affect the administration, security, fairness or proper play or conduct of the Contest.
Any attempt by an entrant or any other individual to deliberately damage the contest web site or undermine the legitimate operation of the contest may be a violation of criminal and civil laws and should such an attempt be made, sponsor reserves the right to prosecute any such individual to the fullest extent permitted by law.
Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. Neither Sponsor nor anyone acting on its behalf will enter into any communications with any entrant regarding this Contest, except as expressly set forth in these Official Rules. Any attempt by any participant to obtain more than the permitted number of entries by using multiple and/or different identities, forms, registrations, addresses or any other method will void all of that participant’s entries and that participant may be disqualified at Sponsor’s discretion. The Sponsor site may contain hyperlinks and pointers to the Internet sites of Third Parties. Sponsor shall not be liable or responsible for the content of the Third Party sites or for any damages any individual or entity may incur as a result of their use of Third Party sites or their reliance on the content of Third Party sites. Any trademarks used in this promotion are property of the respective trademark owners and are used herein for identification purposes only.
L. RELEASE AND LIMITATIONS OF LIABILITY: By participating in this contest, entrants agree that Sponsor and its affiliates, representatives, consultants, contractors, legal counsel, advertising, publications, and promotional, fulfillment, and marketing agencies, and their respective officers, directors, employees, representatives, and agents (collectively, the “released parties”) will have no liability or responsibility whatsoever for, and shall be held harmless by entrants against, any liability for any injuries, losses or damages of any kind. The Released Parties have no liability or responsibility whatsoever for any claims based on publicity rights, defamation or invasion of privacy, or merchandise delivery. Without limiting the foregoing, and except where prohibited by law, everything regarding this contest, including prizes, are provided “as is” without warranty of any kind, either express or implied, including, but not limited to, the implied warranties of merchantability.
